What Legal Documents Does my College Student Need?

Why does my college student need legal documents?  Good question! Because in Pennsylvania, when your child turns the magic age of 18, they are legally adults. Most likely we, as parents, are still supporting them financially and emotionally, but we no longer have the right to act on their behalf. Therefore, having these legal documents in place serves as a safety net for when they’re unable to make decisions themselves.

Below is a list of the legal documents, along with a short description, that every college student should have before heading off to college.

  1. Power of Attorney – this is probably the most important document to have. It authorizes someone to act on behalf of your child. This is most likely one or both parents.
  1. Healthcare Power of Attorney – this is a document where your child would designate a person to make emergency healthcare decisions for them if they are unable to.
  1.  Living Will – this is for your child to make healthcare decisions in advance should they become in a vegetative state or are receiving end of life care.
  1.  HIPPA Release – this document authorizes your child’s medical professionals to release any medical information to you.

* As always, I am not an attorney and cannot offer legal advice but will be happy to refer you to an attorney upon request.
