Paralegal vs. Notary: Key Differences Pennsylvania Residents Should Know

Difference between paralegals and notaries by Diem Notary & Paralegal Services, Pennsylvania

When preparing important legal documents, two different roles often come up: paralegal and notary public. both are essential in the legal world, but they serve very different purposes. Understanding the difference can save you time, reduce confusion, and ensure your documents are handled properly.

What Does a Paralegal Do?

A paralegal is a trained professional who supports attorneys by drafting legal documents, conducting research, and organizing cases. In Pennsylvania, paralegals must work under the supervision of an attorney – they cannot practice law or provide legal advice directly to the public.

Examples of paralegal work include:

✅ Drafting wills, trusts, and powers of attorney (Estate Planning Paralegal Services)
✅ Preparing filings and compliance documents for businesses (Corporate & Business Law Paralegal Services)
✅ Assisting with real estate closings (Real Estate Paralegal Services)

For a full definition , the American Bar Association explains the role of paralegals.

What Does a Notary Do?

A notary public, on the other hand, is a state-appointed official whose primary role is to act as an impartial witness during the signing of important documents. A notary helps deter fraud by:

✅ Verifying the signer’s identity with a government-issued photo ID
✅ Confirming the signer understands the document
✅ Ensuring the signer is acting voluntarily and not under duress
✅ Applying an official seal and signature to certify the notarization

Commonly notarized documents include real estate deeds, affidavits, powers of attorney, trusts, and wills (Notary Services).

For an overview, visit the National Notary Association’s guide to what a notary is or the Pennsylvania Department of State Notary Division.

How Do They Work Together?

Paralegals and notaries often overlap in practice. For example:

⚖️ A paralegal may draft a power of attorney under attorney supervision.
⚖️ A notary ensures that the same document is signed properly and legally recognized.

If a document is bound for use overseas, you may also need an Apostille or Embassy Legalization, which builds on the notary’s certification. Read more about my Apostille services.

Why it Matters for Clients

Knowing the difference helps you navigate the legal process with confidence.

⚖️ A paralegal (working with an attorney) ensures your documents are drafted correctly.
⚖️ A notary ensures those documents are properly executed and legally recognized.

Both roles add layers of accuracy, accountability, and peace of mind.

💡 A paralegal supports attorneys in preparing legal documents, while a notary verifies the signing of those documents. Both are essential to protecting your rights, your property, and your future.
